Dear Dr. Holliday, Ms. Lystlund, Ms. Martin, Mr. Fischer, Ms. Boyd, as representatives and alternate representative of the residents, and Mr. Etheridge of Moreland Altobelli as representative of Bibb County and the Roads Program:

As I believe you know, I have been selected to serve as mediator in the matter of the design and construction of the Forest Hills Road project. Our session has been set for Thursday, February 28, beginning at 9:00 a.m. at the Bibb County Courthouse. At that time, I will facilitate which is hoped will be a resolution of the dispute concerning the project.

Mr. Virgil Adams, the County Attorney, has sent to me a summary of the proceedings up to this point, beginning with the referendum in November of 1994. He has also provided copy of the letter he sent on January 16, on behalf of the Board of Commissioners, to the residents along Forest Hill Road, along with the Proposed Procedures for Mediation. In addition, at my request, I have from him copy of the detailed maps of the two sets of Right of Way Plans from Wimbish Road to Northside Drive and from Vineville Avenue/Forsyth Road to Wimbish Road.

I have reviewed the Proposed Procedures, which are approved barring some significant modification suggested by either group and approved by me. We will go into more specifics regarding the procedure at the outset of the session, and I will be happy then to answer any further questions remaining. Before we begin on Thursday, I will ask each of you (except Ms. Boyd as the alternate, unless she steps in for someone) to sign a brief Mediation Agreement which focuses primarily on the confidentiality aspect and on a commitment to seek settlement in good faith.

In the interim, it would be most helpful if you would please send to me an outline of not more than 4 pages addressing:

1) what you believe the issues are;

2) what practical solutions you propose, including options.

There should be one statement from the residents' representatives and one from Mr. Etheridge. I have not been advised that there are any other parties to be included in the mediation, although any interested person may sign up and speak at the beginning of the session, as stated in the Proposed Procedures. These latter folks will not take part in the mediation as such, but their views can be taken into consideration. Please be assured that these preliminary written statements will be confidential to me and no part of them will be shared with anyone except as authorized by the other side. I ask for the statements to better understand the position of each and what avenues we might discuss.

Kindly send the statements to me via e-mail marked "Priority" by the close of business on Monday, February 25.

If you have any questions about this request or any part of the anticipated session, do not hesitate to send an e-mail and I will respond as soon as possible. I am not at my computer all day, so answers may not be forthcoming until evening.

Please be assured that I am and will remain neutal in this endeavor. My role is to facilitate a discussion with a view to you reaching a resolution acceptable to you, which can go forward for final approval.

Throughout the process, please keep in mind that reasoned and reasonable compromise will be necessary in order to achieve the desired result, which is resolution.

Your representatives will be authorized to speak on your behalf during the negotiation process and to otherwise represent your interests. It is therefore extremely important that the residents of Forest Hill Road convene in some fashion in order to select your representatives. So as not to make the process too cumbersome and unproductive, I suggest you select no more than three (3) persons to serve as your representatives. These persons can be lawyers, non-lawyers, residents or nonresidents of Forest Hill Road. It would be helpful if you could have your representatives selected by January 31, 2008 and provide their names and contact information directly to me. I will then pass this information along to the mediator and from that point forward, she will be in direct communication with your representatives on your behalf and with Moreland Altobelli on behalf of Bibb County and DOT.
