I am waiting to file my complete Appeal until the Judge's Order in this case has been properly filed. 

I understand that according to the statutory requirement of O.C.G.A. 15-6-21(c),  the Plaintiffs are to be sent a copy of the Order by the Judge or the clerk.  

This has not happened yet.  

I here-say that this Order was signed on 6-25-09 and that it was filed on 6-29-09; but I have seen no proof of it, nor do I have any direct knowledge of any filing of the Judge's Orders in this case.

NOTICE OF APPEAL

Pursuant to O.C.G.A. § 5-6-37, Plaintiffs Lindsay Holliday and Louis M Ryan hereby give notice of their appeal to the Court of Appeals.

Plaintiffs are pro-se.

Appellants are appealing the Court’s Order and Judgment granting Defendants’ Motion to Dismiss, entered on June 29, 2009.

Appellants note that the Clerk has already been requested (by plaintiff Lee Johnson's attorney, Charles Cox) to "copy and send to the Court of Appeals the entire record. No part of the record on appeal is to be omitted...   
"The transcript of the proceedings before the Court on April 17, 2009, regarding Defendants’ Motion to Dismiss be filed with the clerk and transmitted as part of the record on appeal." 

Pursuant to O.C.G.A. § 5-6-34, The Court of Appeals has jurisdiction of this case on appeal because it does not concern a matter where, pursuant to Georgia Constitution of 1983, Art. 6, § 6, ¶¶ 2 – 3, the Supreme Court has either exclusive or general appellate jurisdiction.

Service of this Notice of Appeal will be made on the attorney for Defendants in accordance with O.C.G.A. § 5-6-32.
