Dear Mr. Adams:

I write to thank you for the fine arrangements you made for our sessions last week.  You certainly envisioned in advance all of our needs and planned very well accordingly.  The Courthouse courtroom was perfect (except I didn't need to be on the bench and hope I dispelled the thought that I had any judicial power in this instance), and the accommodations in the Fickling Building served our purposes well.  It was wonderful to have access to your office and the copy machine etc.

We appreciate also the provision of lunch so we could continue the rhythm and momentum of our work without the interruption of scattering and reconvening.  Especially on a cold and windy day.

If you have e-mail address for Bret Gillis of Stantec, please let me have it so I can add it to our e-mail list of participants.

Best regards,

Dorothy Toth Beasley

Dear Mr Adams,

In view of the unusual difficulty that we citizens have experienced while trying to obtain maps of the Forest Hill Project, we need to be sure that we are all looking at the same set of drawings before mediation.

This letter is an ORR asking you to disclose whether the map files we acquired on a CD from Moreland-Altobelli  (originating from Stantec Engineering) a few weeks ago are in fact the same plans that you provided to Judge Beasley as indicated in the email below.

Thank-you,
- Lindsay

Mr Adams,

We are trying to determine approximately - how many times the Environmental Assessment, and the Needs and Purpose Statements have been revisited for the Forest Hill Rd Project?

Thank-you,

Dr. Holliday:

1.My answer is the same. The purpose of getting names from the residents was to give the mediator a contact source and let her who would be representing the residents. I have given you the names who will be there form MA of which I am aware at this time. There is no record of names to give you pursuant to an open records request.

2. Please refer to my response to your previous email.

Mr Adams,

1- We complied with your request for a specific list of representatives by the requested date of 1-31-08.  Did the other side not have to do this?  We are respectfully requesting again - an Open Records Request - for the list of all the representatives who will be at the Mediation table.

2- Over 20 people have asked me about the proposed procedures that you prepared for Mediation - setup for 2-28-08.

We can easily assist by forwarding it to them by email if you send us the text file.

Otherwise we will instruct them how to each submit their individual Open Records Requests to the Roads Improvement Program c/o Bibb County or GDOT.

Mr Adams,
You list only two people who will represent the Road Improvement Program for mediation - Ken Sheets and Van Etheridge.

1- Are those two and the mediator to be the only other people involved in mediation other than the citizens?

And,
2- Please email us the guidelines and planned procedure for the mediation.

Thank-you,

Dr. Holliday:
In response to your open records request, I have contacted DOT and learned that it is their policy not to disclose purchase price for ROW until such time as all of the property to be acquired has been acquired. They deem this information to be exempt under section 50-18-72(a)(6) of the Ga. Open Records Act. This is based on an Attorney's General Opinion.

3- Terry Sapp for ROW at 721 FHR.

Please reply by E-Mail if it is not too much trouble.

To: Bibb County Attorney - Virgil Adams

Dear Mr Adams,
The GDOT rate for CDs is $12, and the information supplied from Stantec appeared to fit onto just one CD when I reviewed it at the Moreland-Altobelli office on Friday afternoon.

GDOT people I spoke to last Friday seemed to be surprised and unaware that the [ Road Improvement Program] was trying to overcharge us, and "RIP" us off for these CDs.

If your CDs contain additional information that was not on the one CD that I viewed at Moreland Altobelli, then please let me know. (?)

The data I viewed was in 2 folders:
"76100115"  contained 724 files in 57 folders for a total of 332MB.
"76100114"  contained 445 files in 23 folders totaling 153 MB

Most of these files are of a format type .DGN which is unrecognizable, and therefore of no use to us.  No files of this type were requested by us.

We are still reviewing the .PDF, JPG and GIF files to see if all the requested information is there.  The ROW drawings for the Southern part of FHR are in Metric measurements, and this is quite confusing since Northern designs use English.
Why is this project split into two different measurement standards?

[And] We still want the hydrology study in digital form.  Somebody's computer (and backups) at Stantec have the file we want.  Do I need to call Stantec myself to ask who typed the report?   This one hydrology report cost the taxpayers over $50,000.  I can not believe that it is not readily available...

Thank-you,
- Lindsay

Mr Adams,
I just now spoke to GDOT about the digital files.
GDOT says the information in those CDs belongs to GDOT.
And they further stated that GDOT charges a standard published rate of $12 per CD.

I will be calling you to set a time soon.

Dear Mr Adams,

Forest Hill Neighbors and Friends met 2 days ago at St Francis Church to choose representatives for the Mediation.
The meeting is summarized here:
http://www.macon-bibb.com/FHR/Meeting_20080129.htm

We chose 5 people.  One of us could serve as an "alternate" if the Judge will not seat more than 4 of us at the table.

Our choices to represent us during Mediation are listed here with their emails:
- Carol Lystlund < CLystlund@AtlanticSouthernBank.com>,
- Lindsay Holliday <teeth@mindspring.com>
- Susan Hanberry Martin <shanberry@stratford.org >,
- Dan Fischer <FISCHER_DP@Mercer.edu >,
- Alice Boyd <dmbx1@cox.net>,  {alternate}

Thank-you,
- Lindsay

Dr. Holliday:

In response to your questions:

1. Not to my knowledge.
2. Letters were sent to owners of property on Forest Hill Road since the Board limited the mediation to Forest Hill Road property owners. Of course anyone can attend the initial session. I believe some additional letters were sent yesterday to those owning property abutting Forest Hill Road that may not have been included initially. If that has not been given to you I will ask Janice Ross to do so.
3. Explained above.
